These Terms of Service ("Terms") govern your use of the services provided by Fox Hunt Digital ("Fox Hunt Digital," "we," "us," or "our"), including our AI-powered automation and SMS communication services delivered to small businesses. By engaging our services or using any Fox Hunt Digital platform, you agree to these Terms.

1. Services

Fox Hunt Digital provides AI-powered operator services including, but not limited to, automated SMS outreach, customer reactivation campaigns, review acceleration, declined-service follow-up, and business performance reporting. These services are delivered on behalf of client businesses ("Clients") to their existing customers ("End Users"). All messaging services are operated in compliance with applicable federal and state regulations, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and carrier guidelines established by the CTIA.

2. SMS Messaging Terms

By enrolling in Fox Hunt Digital's SMS services, you acknowledge and agree to the following:

• Message Types: You may receive text messages including service follow-ups, appointment reminders, maintenance recommendations, review requests, and reactivation messages from businesses you have previously transacted with.
• Message Frequency: Message frequency varies based on your service history and business interactions. You may receive up to 4–8 messages per month depending on your engagement.
• Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier plan.
• Opt-Out: You may opt out of receiving SMS messages at any time by replying STOP to any message. You will receive a single confirmation message and no further messages will be sent.
• Help: For assistance, reply HELP to any message or contact us at support@foxhuntdigital.com.
• Consent is not a condition of purchase. You are not required to consent to receive SMS messages as a condition of purchasing any goods or services.

3. Client Responsibilities

Clients engaging Fox Hunt Digital services agree to:

• Ensure that all End User contact information provided has been obtained lawfully and with appropriate consent.
• Use Fox Hunt Digital's designated opt-in mechanisms or provide equivalent documented consent prior to any messaging campaigns.
• Maintain accurate business information for brand registration purposes.
• Not use Fox Hunt Digital services to send unsolicited, deceptive, or unlawful messages.

Fox Hunt Digital reserves the right to suspend services for any Client whose messaging practices violate applicable law or carrier guidelines.

4. Prohibited Uses

You may not use Fox Hunt Digital services to:

• Send messages to individuals who have not provided consent or who have previously opted out.
• Transmit spam, phishing content, or any fraudulent communications.
• Violate any applicable federal, state, or local law or regulation.
• Impersonate any person, business, or entity.
• Send content that is obscene, harassing, threatening, or otherwise objectionable.

5. Privacy

Your use of Fox Hunt Digital services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We do not sell personal information to third parties.

6. Intellectual Property

All content, software, workflows, automation scripts, AI prompts, and materials developed by Fox Hunt Digital remain the intellectual property of Fox Hunt Digital. Clients are granted a limited, non-exclusive license to use deliverables during the term of their engagement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Fox Hunt Digital shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability for any claim shall not exceed the fees paid by you in the three months preceding the claim.

8. Modifications to Terms

Fox Hunt Digital reserves the right to update these Terms at any time. We will notify Clients of material changes via email or through our platform. Continued use of services after notice constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Orange County, California.
